1. What Second Pass Is
Second Pass is a professional and educational creative community intended to help people improve their work through critique, iteration, problem-solving, knowledge sharing, portfolio presentation and constructive interaction.
The Service may include, among other things:
- creative and technical Workbenches;
- requests for feedback;
- requests for help;
- iterative project updates through Passes;
- Contributions and Replies;
- portfolios and Portfolio Projects;
- user profiles;
- software, discipline and skill classifications;
- Guides and other Library content;
- community recognition systems;
- search and discovery;
- following and saving features;
- personalised or recommended content;
- notifications;
- moderation and reporting tools;
- administrative and support services; and
- additional functionality introduced over time.
Second Pass is intended to facilitate learning, critique, professional development and constructive knowledge exchange.
Unless a particular feature expressly states otherwise, Second Pass is not:
- an employer;
- educational institution;
- university;
- professional certification authority;
- employment agency;
- talent agency;
- freelance marketplace;
- payment intermediary;
- professional licensing authority; or
- guarantor of the qualifications, identity or competence of its users.
2. Definitions
For these Terms:
Account
A registered Second Pass user account.
Content
Anything submitted, uploaded, published, transmitted, embedded or otherwise made available through the Service, including text, images, artwork, renders, screenshots, videos, links, profile information, Contributions, Replies, feedback, project descriptions, Guides, portfolio material and associated metadata.
User Content
Content provided by a user rather than by Second Pass.
Public Content
User Content made available through a publicly accessible part of the Service.
Workbench
A Second Pass content page through which a user presents work, a problem, a question or another eligible subject for critique, help, discussion or iterative development.
Pass
A particular published iteration or version within a Workbench.
Contribution
Feedback, critique, technical advice, an answer, solution or other substantive contribution made in connection with another user's Content.
Reply
A response to a Contribution or another eligible item of Content.
Portfolio Project
A project a user publishes as part of their Second Pass Portfolio.
Guide
Content published or submitted to the Second Pass Library for the purpose of explaining a focused technique, workflow, solution, process or area of knowledge.
Recognition
Any Second Pass mechanism used to indicate community appreciation, usefulness, contribution, reputation, expertise, portfolio activity or similar signals. Recognition may include counts, labels, summaries, tiers, achievements, Helpful or similar acknowledgements, Portfolio Recognition or other reputation indicators.
Moderation
Reviewing, classifying, restricting, labelling, demoting, rejecting, removing or restoring Content, and warning, restricting, suspending or terminating Accounts.
3. Eligibility
You must be at least 16 years old to create or operate a personal Account unless Second Pass expressly permits a different minimum age in your country.
If the law applicable to you requires you to be older in order to enter into these Terms independently, you may use the Service only where the applicable legal requirements have been satisfied.
You may not use the Service if:
- you are legally prohibited from doing so;
- we have previously permanently terminated your Account and have not authorised your return; or
- your use would violate applicable law.
If you use Second Pass on behalf of an organisation, studio, university, company or other entity, you represent that you are authorised to do so where such authority is required.
4. Your Account
You are responsible for providing accurate information when creating and maintaining your Account.
You must keep your login credentials secure.
You must not:
- give another person unauthorised access to your Account;
- impersonate another person or organisation;
- register a username intended to mislead users about your identity;
- falsely claim an affiliation, professional position or qualification;
- sell or commercially trade Accounts without permission;
- create Accounts for deceptive purposes;
- create or use multiple Accounts to manipulate Recognition, rankings, feedback, moderation or engagement;
- use another Account to evade restrictions imposed on your Account; or
- knowingly allow another person to use your Account in violation of these Terms.
If you believe your Account has been compromised, you should notify us promptly through the available support channels.
We may require additional verification where reasonably necessary to:
- protect Accounts;
- investigate suspected abuse;
- administer sensitive Account actions;
- protect the integrity of Recognition systems;
- prevent fraud; or
- comply with applicable law.
5. User Profiles
Users may publish professional or creative information through their profiles. Depending on available features, this may include:
- display name;
- username;
- avatar;
- biography;
- professional title;
- general location;
- disciplines;
- skills;
- software;
- Portfolio;
- professional links;
- Contribution history;
- Recognition information; and
- other information selected by the user.
You control the information you choose to provide, subject to mandatory Account information and applicable product settings.
You must not knowingly publish false or materially misleading professional claims. In particular, you must not falsely represent:
- your identity;
- qualifications;
- employment;
- education;
- professional credits;
- authorship;
- client relationships;
- project involvement;
- professional licences;
- certifications; or
- expertise.
A user's profile, Portfolio, Recognition or activity on Second Pass should not be treated as independent verification by Second Pass unless a particular fact is expressly identified as verified.
6. Public Visibility and Search Engines
Second Pass contains public areas. Content you designate or publish as public may be visible to:
- registered users;
- visitors without Accounts;
- search engines;
- search-engine caches;
- social-media previews;
- web archives where legally permitted;
- third-party services following public links; and
- other people on the internet.
Public profiles, Portfolio Projects, Workbenches, Passes, Guides and Contributions may therefore be indexed by search engines.
Changing or deleting Content on Second Pass does not guarantee that copies previously indexed, cached, copied, shared or independently stored by third parties will immediately disappear.
Do not publish information publicly that you do not want to be publicly accessible.
7. Workbenches and Passes
One of the central features of Second Pass is iterative improvement.
A Workbench may contain one or more Passes representing different stages of a project, problem or creative process.
When you publish an additional Pass:
- previous Passes may remain accessible;
- the Workbench may show the chronology of your revisions;
- users may compare earlier and later Passes;
- Contributions associated with previous Passes may remain associated with those Passes;
- the Service may display changes between Passes; and
- the Service may display relationships between Contributions and subsequent revisions.
This structure is intended to preserve the context of creative development and allow people to understand how work evolves.
You should therefore treat each published Pass as part of a potentially persistent public revision history.
Second Pass may provide editing or deletion controls, but publishing a new Pass does not automatically erase or overwrite earlier Passes.
8. Contributions, Critique and Advice
Second Pass encourages substantive critique, technical discussion and constructive disagreement.
Users may express different views about creative, artistic, technical and professional matters.
A disagreement with your work, decisions, technique or advice is not, by itself, harassment.
Users must nevertheless engage in good faith and comply with these Terms and the Community Guidelines.
Constructive criticism may address subjects including:
- composition;
- topology;
- modelling;
- lighting;
- rendering;
- materials;
- texturing;
- animation;
- design decisions;
- workflow;
- programming;
- technical implementation;
- presentation;
- optimisation;
- performance;
- artistic direction; or
- another relevant aspect of submitted work.
Criticism of work must not become abuse directed at a person.
Users may not use critique as a pretext for:
- harassment;
- humiliation;
- threats;
- discriminatory abuse;
- stalking;
- intimidation; or
- repeated personal attacks.
9. Technical and Creative Advice Is Not Guaranteed
Contributions on Second Pass are generally provided by independent users.
Unless expressly stated otherwise, Second Pass does not verify every Contribution.
Technical or creative information may be:
- incomplete;
- outdated;
- incompatible with your software version;
- unsuitable for your hardware;
- incorrect;
- inefficient;
- subjective; or
- inappropriate for your particular project.
You remain responsible for deciding whether to follow advice provided through the Service.
Before making significant changes to professional projects, production data, source files, code, hardware, render systems or other important material, you should maintain appropriate backups and independently verify important changes where necessary.
Second Pass is not responsible merely because advice supplied by another user does not produce the result you expected.
Nothing on Second Pass should be treated as legal, medical, financial, safety-critical or other regulated professional advice unless the person providing it is independently qualified and an appropriate professional relationship exists.
10. Portfolio Content
You may publish work through Portfolio Projects where the applicable functionality is available.
You must have the necessary rights to publish everything you include. This includes:
- artwork;
- renders;
- models;
- photographs;
- videos;
- audio;
- music;
- textures;
- logos;
- client work;
- collaborative work;
- screenshots;
- source material; and
- other intellectual property.
Publishing something in your Portfolio does not establish that you created it.
You must accurately describe your role where authorship or project responsibility could otherwise be misleading.
For collaborative work, you should identify your contribution where reasonably appropriate.
You must not publish:
- confidential client work;
- material covered by a non-disclosure agreement;
- unreleased commercial assets;
- internal studio information; or
- other material you are not authorised to disclose.
11. Ownership of Your Content
You retain ownership of your User Content.
Second Pass does not acquire ownership of your artwork, Portfolio, Workbenches, Passes, Contributions or other original User Content merely because you publish it through the Service.
You are responsible for ensuring that you have all rights necessary to upload and publish your User Content.
12. Licence You Give Second Pass
In order to operate the Service, you grant Second Pass a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, technically process, format, resize, transcode, display, distribute and make available your User Content as reasonably necessary to:
- operate the Service;
- display your Content to the audiences you selected;
- generate thumbnails and previews;
- operate search;
- provide feeds and recommendations;
- maintain Workbench and Pass histories;
- provide sharing functionality;
- maintain backups;
- protect the Service;
- detect abuse;
- troubleshoot technical problems; and
- provide, maintain and improve Service functionality.
This licence permits us to use infrastructure providers and other processors acting on our behalf where necessary to operate the Service.
This licence does not transfer ownership of your work to Second Pass.
It does not give Second Pass a general right to sell ownership of your artwork to another person.
Except where separately disclosed and lawfully agreed, these Terms do not grant Second Pass a general right to license your creative work to unrelated third parties for unrelated commercial exploitation.
Where Second Pass wishes to make a substantial use of an individual user's creative work outside the ordinary operation or reasonable promotion of the Service, additional permission may be requested where appropriate.
13. AI and User Content
Second Pass may use automated or machine-assisted technology for legitimate platform purposes including:
- spam detection;
- abuse detection;
- moderation assistance;
- search;
- Content classification;
- discipline suggestions;
- skill suggestions;
- software identification or suggestions;
- duplicate detection;
- recommendations;
- fraud prevention;
- security; and
- improving platform functionality.
Where automated systems materially contribute to a moderation decision, information about their involvement will be provided where required by applicable law.
These Terms do not give unrelated third parties unrestricted permission to take your Portfolio or artwork and train their own generative AI systems on it.
These Terms also do not establish a general licence for Second Pass to commercially exploit user artwork as generative-AI training data.
If Second Pass later proposes a materially different use of User Content for generative-model training beyond ordinary platform operation, moderation, security, classification or similar functionality, the applicable terms and privacy information will be updated as required before such a use is introduced.
Second Pass may introduce AI-content disclosure requirements.
Users must not intentionally misrepresent the authorship or production method of AI-generated or materially AI-assisted work where doing so would deceive other users about how the work was created.
14. Intellectual Property of Other People
You may only upload Content that you have the legal right to use.
You must not publish Content that infringes another person's:
- copyright;
- trademark;
- design rights;
- patent rights;
- moral rights;
- publicity rights;
- database rights;
- trade secrets;
- contractual rights; or
- other intellectual-property rights.
The fact that material is accessible online does not mean that it is free to copy or redistribute.
When using assets, reference images, textures, models, code, plugins, brushes, music, fonts or other third-party material, you remain responsible for complying with the applicable licence.
15. Intellectual-Property Complaints
If you believe Content on Second Pass infringes rights that you own or are authorised to enforce, you may submit an intellectual-property complaint through the contact mechanism designated for intellectual-property reports at /copyright/report. Complaints and ownership rules are governed by our Copyright & Intellectual Property Policy.
A complaint should provide sufficient information for us to identify and assess the issue, including where appropriate:
- identification of the protected work or right;
- identification of the allegedly infringing Content;
- the location or URL of that Content;
- your contact information;
- an explanation of the basis of your claim;
- evidence of authority where you act for another rightsholder; and
- a statement that the information supplied is accurate to the best of your knowledge.
We may request additional information where reasonably necessary.
We may remove or restrict Content where appropriate and may notify the affected user.
Users who repeatedly or seriously infringe intellectual-property rights may have their Accounts restricted or terminated.
16. Guides and the Library
Second Pass may maintain a Library containing Guides or other curated knowledge.
Guide submissions may be subject to review before publication. A Guide may be:
- approved;
- rejected;
- returned for revision;
- classified as duplicative;
- linked to an existing Guide;
- treated as an alternative method;
- updated;
- archived; or
- removed.
Editorial approval means only that Second Pass has accepted the Guide for publication under the applicable standards.
Approval does not constitute:
- a warranty that the Guide is correct;
- professional certification;
- proof of originality;
- a guarantee of safety;
- a guarantee of compatibility;
- a guarantee that no alternative method exists;
- an endorsement by a software vendor; or
- a guarantee that the method remains current.
Software and professional workflows evolve. Users should therefore consider software version, publication date, context and subsequent developments when relying on Guides.
Second Pass may revise Library classification, metadata, relationships, tags and publication status where reasonably necessary to maintain the usefulness and quality of the Library.
17. Recognition, Appreciation and Reputation
Second Pass may provide systems that recognise constructive participation and creative activity. These may include:
- Helpful or equivalent acknowledgements;
- Appreciation;
- applied-feedback indicators;
- Contribution counts;
- Portfolio Recognition;
- reputation;
- subject-specific recognition;
- levels;
- ranks;
- tiers;
- achievements;
- badges;
- recognition summaries; and
- other community signals.
Different Recognition systems may measure different activities. For example, Appreciation of a Portfolio Project may represent a different form of activity from Recognition earned through helpful Contributions.
Unless expressly stated otherwise, Recognition:
- is not money;
- has no cash value;
- cannot be redeemed for money;
- is not property;
- is not transferable;
- does not establish professional accreditation;
- does not establish employment eligibility;
- does not guarantee expertise;
- does not create ownership in Second Pass;
- does not guarantee access to future features; and
- does not entitle a user to compensation.
Second Pass may define eligibility rules, thresholds, abuse protections, weighting systems and calculation methods for Recognition. These systems may evolve as the platform develops.
We may correct, reverse or recalculate Recognition where it resulted from:
- technical errors;
- deleted or invalid activity;
- fraud;
- coordinated manipulation;
- multiple-account abuse;
- self-dealing;
- artificial engagement;
- moderation reversals;
- spam; or
- other behaviour inconsistent with the intended purpose of the system.
Users must not buy, sell, exchange, coordinate or artificially manufacture Recognition.
18. Recognition Is Not Professional Certification
Second Pass Recognition represents activity within the Service. Labels such as:
- Recognized;
- Established;
- Distinguished;
- Helpful;
- appreciated;
- Portfolio Recognition;
- recognition summaries; or
- other Second Pass indicators
do not mean that Second Pass:
- employs the user;
- licenses the user;
- professionally certifies the user;
- guarantees the user's competence;
- guarantees the user's identity unless separately verified;
- endorses all of the user's opinions;
- guarantees the quality of services they may provide; or
- recommends entering into a commercial relationship with them.
Users remain responsible for carrying out appropriate checks before hiring, collaborating with, paying or otherwise relying professionally on another user.
19. Prohibited Content and Conduct
You must not use Second Pass to publish, facilitate or promote Content or behaviour that is illegal or prohibited under these Terms or the Community Guidelines.
Prohibited activity includes, where applicable:
Illegal activity
Content or behaviour that violates applicable law.
Intellectual-property infringement
Unauthorised publication, distribution or misuse of protected material.
Harassment and threats
Threats, targeted harassment, stalking, intimidation or sustained personal abuse.
Hate and discriminatory abuse
Content attacking or dehumanising people based on protected characteristics where prohibited by applicable law or our Community Guidelines.
Sexual exploitation
Sexual exploitation, sexual Content involving minors, grooming, non-consensual intimate imagery or other unlawful sexual material.
Privacy violations
Publishing another person's private or sensitive information without permission or another lawful basis.
Fraud and deception
Phishing, impersonation, scams, fraudulent opportunities, deceptive schemes or intentionally false claims intended to obtain money, credentials or another benefit.
Malware and cybersecurity abuse
Malware, malicious scripts, credential theft, exploit delivery, destructive payloads or use of Second Pass infrastructure to compromise other systems.
Spam
Repeated irrelevant promotion, automated spam, unsolicited mass messaging or manipulative link-building.
Manipulation
Artificially manipulating feeds, Recognition, Appreciation, Helpful signals, search, rankings, analytics or engagement.
Restriction evasion
Creating new Accounts or using another person's Account to circumvent an Account restriction.
Unauthorised automation
Bots, scraping or automated access that materially burdens the Service, bypasses technical restrictions or violates published platform rules.
Interference
Attempting to disrupt, overload, damage or impair Second Pass infrastructure.
Unauthorised access
Attempting to access Accounts, administrative systems, private information or restricted systems without authorisation.
Misleading professional claims
Materially misrepresenting authorship, qualifications, professional experience, project credits, identity or affiliation.
Abusive reporting
Repeatedly submitting knowingly false, malicious or manifestly unfounded reports.
20. Mature Creative Content
Creative work can include anatomy studies, horror, violence, artistic nudity, disturbing imagery and other mature subjects.
Second Pass may distinguish between legitimate mature creative work and prohibited material.
We may require mature Content to:
- use available content warnings;
- be appropriately labelled;
- avoid inappropriate thumbnails;
- be restricted from certain feeds;
- be age-restricted;
- comply with Community Guidelines; or
- be removed where it crosses applicable legal or platform boundaries.
Artistic, fictional, educational or professional context does not make unlawful Content permissible.
21. Commercial Activity and Promotion
Reasonable professional self-presentation may be permitted. For example, a profile may contain professional links or indicate availability for work where supported by the Service.
However, unless expressly enabled, Second Pass is not a general advertising marketplace.
You must not:
- repeatedly solicit users through irrelevant Contributions;
- use Contributions primarily as advertising;
- send unsolicited mass commercial messages;
- manipulate Content to promote affiliate links;
- operate deceptive recruitment schemes;
- publish fraudulent employment opportunities; or
- disguise paid advertising as independent community advice.
Second Pass may introduce specific rules for commercial, sponsored, recruitment or promotional activity.
22. Freelance Work and Off-Platform Transactions
Users may discover other professionals through Second Pass.
Unless a transaction is expressly offered through a Second Pass commercial feature, Second Pass is not a party to agreements independently made between users. This may include:
- freelance contracts;
- employment relationships;
- asset sales;
- consulting arrangements;
- collaboration agreements; or
- other commercial transactions.
Second Pass does not guarantee:
- payment;
- delivery;
- quality;
- identity;
- professional qualifications;
- contractual performance; or
- legality of an off-platform transaction.
23. Mentorship
General community assistance on Second Pass is not automatically a paid mentorship relationship.
Second Pass may introduce a dedicated Mentorship service in the future.
If paid mentorship, Mentor verification, scheduling, payments or similar functionality is introduced, additional terms may apply concerning matters such as:
- Mentor eligibility;
- verification;
- payments;
- platform fees;
- cancellations;
- scheduling;
- refunds;
- private mentorship spaces;
- professional conduct;
- reviews; and
- disputes.
Any applicable additional terms will be presented before users enter the relevant service.
Nothing in these Terms requires Second Pass to introduce Mentorship functionality.
24. Community Guidelines
The Second Pass Community Guidelines form part of the rules governing use of the Service.
The Community Guidelines may provide more detailed rules concerning:
- constructive critique;
- harassment;
- discrimination;
- mature Content;
- spam;
- self-promotion;
- misleading information;
- plagiarism;
- AI-generated Content;
- intellectual-property misuse;
- prohibited Content;
- Recognition manipulation;
- reporting abuse; and
- moderation practices.
Where these Terms establish a general rule and the Community Guidelines provide more specific instructions concerning how that rule applies, users must comply with both.
If there is a direct conflict concerning contractual rights, these Terms control unless applicable law requires otherwise.
25. Content Moderation
Second Pass may moderate Content in order to:
- enforce these Terms;
- enforce Community Guidelines;
- comply with law;
- protect users;
- protect intellectual property;
- maintain community quality;
- prevent fraud;
- combat spam;
- protect Service security; and
- preserve the intended purpose of Second Pass.
Depending on the circumstances, moderation measures may include:
- taking no action;
- changing classification or metadata;
- adding a warning;
- requiring a Content warning;
- restricting recommendations;
- reducing visibility;
- restricting search visibility;
- disabling an embed;
- restricting Contributions or Replies;
- locking a discussion;
- rejecting a Guide;
- returning a Guide for revision;
- removing Content;
- removing Recognition associated with invalid activity;
- warning a user;
- temporarily restricting features;
- temporarily suspending an Account; or
- permanently terminating an Account.
We aim to apply moderation measures proportionately and consistently while taking relevant context into account.
Not every violation requires the same response. Relevant factors may include:
- severity;
- intent;
- harm;
- frequency;
- previous violations;
- whether the conduct was deliberate;
- whether illegal Content is involved;
- whether the user attempted to evade enforcement; and
- whether immediate action is necessary to protect users or the Service.
26. Automated Moderation and Human Review
Second Pass may use automated systems to assist with:
- spam identification;
- suspicious behaviour detection;
- duplicate detection;
- abuse detection;
- Content classification;
- security;
- prioritisation of reports; and
- moderation workflows.
Automated systems may produce false positives or false negatives.
Where appropriate or legally required, material moderation decisions may be subject to human review.
Where applicable law requires us to disclose the use of automated means in relation to a moderation decision, we will do so.
27. Reporting Illegal Content
Second Pass provides or intends to provide an electronic mechanism through which individuals and organisations can report specific Content they believe is illegal.
A sufficiently substantiated notice should generally identify:
- the Content concerned;
- its precise electronic location or URL;
- the reason the notifier believes it is illegal;
- the relevant legal basis where known;
- contact information where required; and
- a good-faith statement that the submitted information is accurate and complete to the best of the notifier's knowledge.
Second Pass will process notices in accordance with applicable law. Where required, we will acknowledge receipt and communicate our decision.
A report does not automatically require removal. Following review, Content may be:
- found unlawful;
- found to violate platform rules;
- determined to require additional information;
- determined not to violate applicable rules; or
- impossible to assess adequately from the submitted information.
28. Reasons for Moderation Decisions
Where required by applicable law, users affected by certain moderation restrictions will receive an explanation of the decision. Depending on the circumstances, this may include:
- what action was taken;
- what Content was affected;
- the duration of the restriction;
- whether a user report contributed to the decision;
- whether automated systems were materially involved;
- the applicable legal basis where illegal Content is concerned;
- the relevant provision of these Terms or Community Guidelines; and
- available methods of appeal or redress.
We may withhold information where disclosure would:
- violate applicable law;
- compromise safety;
- expose protected information;
- facilitate abuse; or
- materially undermine fraud, security or abuse-prevention systems.
29. Appeals
Where Second Pass provides an internal appeal mechanism, eligible users may ask us to reconsider specified moderation decisions.
Where applicable law requires an internal complaint system, qualifying complaints will be handled:
- electronically;
- without charge;
- in a timely manner;
- diligently;
- objectively;
- without discrimination; and
- with appropriate human oversight where required.
A successful appeal may result in:
- restoration of Content;
- restoration of an Account;
- reduction of a restriction;
- correction of Recognition;
- reclassification; or
- another appropriate remedy.
Submitting an appeal does not guarantee reversal of the original decision.
30. Repeated Illegal Content and Abuse of Reporting Systems
Second Pass may take action against users who repeatedly provide manifestly illegal Content.
We may also take action against people who repeatedly submit reports or complaints that are manifestly unfounded.
When assessing repeated misuse, relevant factors may include:
- number of incidents;
- proportion of problematic activity compared with legitimate activity;
- period over which the activity occurred;
- seriousness of the conduct;
- consequences for other users;
- whether the conduct appears intentional;
- previous warnings; and
- attempts to evade enforcement.
Warnings will be provided where required by applicable law.
31. Administrative Actions
Second Pass administrators and authorised staff may access administrative tools necessary to operate the Service. Subject to internal permissions and applicable law, administrative functions may include:
- reviewing Accounts;
- reviewing Content;
- reviewing reports;
- suspending or restoring Accounts;
- removing or restoring Content;
- correcting taxonomy information;
- managing Guides;
- investigating abuse;
- reviewing Recognition anomalies;
- investigating fraud;
- reviewing security activity;
- responding to support requests; and
- carrying out other legitimate administrative functions.
Administrative access does not permit information to be used for unrelated personal purposes.
Sensitive administrative actions may be logged or audited.
32. Service Integrity and Abuse Prevention
You must not attempt to discover, exploit or misuse vulnerabilities in Second Pass.
If you identify a security vulnerability, you should report it responsibly through the security contact method made available by SecondPass.net.
You must not:
- access another user's private data without authorisation;
- modify data you are not authorised to modify;
- exfiltrate information;
- install persistence;
- degrade the Service;
- use a vulnerability to harm other people;
- publicly disclose a vulnerability in a manner likely to cause avoidable harm before reasonable remediation can occur; or
- demand payment through threats.
Nothing in this section is intended to prohibit legitimate security research conducted in accordance with an applicable Second Pass vulnerability-disclosure policy.
33. Third-Party Services, Links and Embeds
Second Pass may interact with third-party services. This may include:
- YouTube;
- Vimeo;
- portfolio platforms;
- social networks;
- authentication providers;
- storage services;
- analytics providers;
- email providers;
- external websites; and
- other integrations.
Third-party services operate under their own terms and privacy practices.
Second Pass does not control third-party services and cannot guarantee their continued availability, security, accuracy or functionality.
If you submit a link or supported embed, you authorise Second Pass to display the information necessary to provide that link or embed through the Service.
34. Privacy and Personal Data
Our processing of personal data is governed by the Second Pass Privacy Policy.
The Privacy Policy explains matters including:
- the identity of the data controller;
- controller contact information;
- what personal data is collected;
- why data is processed;
- legal bases for processing;
- service providers;
- retention;
- cookies and analytics;
- international data transfers where applicable;
- user rights; and
- privacy contact information.
These Terms do not replace the Privacy Policy.
You should avoid publishing unnecessary personal or sensitive information in publicly accessible Content.
35. Account Closure by You
You may stop using Second Pass at any time.
Where Account deletion functionality is available, you may request closure through the relevant Account settings or available support channel.
Closing an Account does not necessarily mean that every piece of Content will immediately disappear. Subject to applicable law and the Privacy Policy:
- deleted Content may remain temporarily in backups;
- records may be retained where required for security, fraud prevention, dispute handling or legal obligations;
- information previously shared with others may remain in their possession;
- public search-engine caches are outside our direct control; and
- Contributions may, where legally permissible and appropriate, remain in anonymised or de-identified form to preserve the integrity of discussions.
Your data-protection rights are not waived by this section.
36. Suspension and Termination by Second Pass
We may restrict, suspend or terminate access where there is a legitimate reason, including:
- serious or repeated violation of these Terms;
- serious or repeated violation of Community Guidelines;
- illegal activity;
- fraud;
- security threats;
- harassment;
- intellectual-property infringement;
- manipulation of Recognition;
- restriction evasion;
- Account compromise;
- legal obligations;
- orders from competent authorities; or
- misuse that materially threatens the Service or other users.
Where appropriate, we may warn you before suspension or termination.
Immediate action may be taken where reasonably necessary because of serious misconduct, illegal Content, security risk or risk of harm.
Where required by law, we will provide reasons and information concerning available redress.
37. Inactive Accounts
Second Pass may adopt an inactive-Account policy in the future.
If Accounts are to be removed solely because they have been inactive for an extended period, reasonable advance notice will be provided where practicable and required.
38. Changes to the Service
Second Pass is an evolving platform. We may add, modify, replace or discontinue features for legitimate reasons including:
- improving the Service;
- responding to user feedback;
- improving security;
- preventing abuse;
- complying with law;
- changing technical infrastructure;
- replacing third-party providers;
- responding to actual product usage;
- testing new functionality; or
- removing functionality that is unsuccessful or unsustainable.
We do not guarantee that every feature available today will remain available indefinitely.
Where future paid functionality is affected, applicable consumer rights and any additional terms governing the paid service will continue to apply.
39. Current Development Status
Second Pass may be offered during periods of active development, testing, early access or beta operation. During such periods:
- features may change substantially;
- certain functionality may be incomplete;
- bugs may occur;
- data presentation may change;
- interfaces may be redesigned;
- Recognition calculations may be adjusted;
- features may be introduced or withdrawn; and
- testing functionality may behave differently from a later production version.
Users should not rely on unfinished functionality as permanently available.
This section does not remove any rights that cannot lawfully be excluded.
40. Changes to These Terms
We may update these Terms where reasonably necessary, including because of:
- changes to the Service;
- new functionality;
- legal or regulatory requirements;
- security requirements;
- abuse-prevention measures;
- changes to technical infrastructure;
- clarification of existing provisions; or
- introduction of commercial services.
These Terms do not give Second Pass an unrestricted right to impose arbitrary contractual changes.
For material changes, reasonable notice will be provided through appropriate means such as:
- an Account notification;
- a notice on the Service; or
- email.
Where applicable law requires your consent to a change, we will request it.
41. Current Free Service and Future Paid Features
At the time these Terms are adopted, the core Second Pass community service may be offered without charge.
Second Pass may introduce optional paid functionality in the future.
A user will not become liable for a new fee merely because paid functionality is introduced.
Before entering into a paid service, users will be provided with the information and additional terms applicable to that service. This may include:
- price;
- taxes;
- billing frequency;
- payment conditions;
- duration;
- renewal;
- cancellation;
- withdrawal rights;
- refunds; and
- service-specific rules.
Future paid services may be governed by supplemental terms. Mandatory consumer rights will remain applicable.
42. Future Business Operation
SecondPass.net is currently independently operated and may later be operated through a registered business or other legal entity.
If responsibility for the Service is transferred to a newly established or successor business, users will be informed where required by applicable law.
The Terms and Privacy Policy will be updated to identify the relevant operator or controller where necessary.
A future change in organisational form does not by itself remove rights that users have under applicable law.
43. Second Pass Intellectual Property
The Service itself, including its software, branding, interface, design system, logos, trademarks, original text, platform graphics and proprietary technology, is owned by or licensed to the operator of Second Pass.
These Terms do not transfer ownership of Second Pass intellectual property to you.
Subject to these Terms, you are granted a limited, personal, non-exclusive, non-transferable and revocable right to access and use the Service for its intended purpose.
You may not, except where applicable law expressly permits:
- copy substantial protected parts of the Service;
- sell unauthorised access to the Service;
- falsely represent Second Pass branding as your own;
- use Second Pass trademarks misleadingly;
- circumvent access restrictions;
- reverse engineer protected elements where legally prohibited; or
- reproduce the Service for the purpose of operating a materially deceptive clone.
44. Suggestions and Product Feedback
We welcome feedback about Second Pass. If you voluntarily provide:
- ideas;
- suggestions;
- feature requests;
- bug reports;
- interface suggestions; or
- other feedback concerning Second Pass itself,
you permit us to consider and use that feedback without an obligation to compensate you.
This provision concerns suggestions about the platform. It does not transfer ownership of artwork, Portfolio Projects, Workbench Content or other creative work merely because you publish it through Second Pass.
45. Availability of the Service
We aim to keep Second Pass reliable, but uninterrupted availability cannot be guaranteed. The Service may occasionally be unavailable because of:
- maintenance;
- software failures;
- infrastructure problems;
- security incidents;
- network failures;
- third-party outages;
- upgrades;
- data migrations;
- emergencies; or
- circumstances outside our reasonable control.
We may temporarily restrict functionality where reasonably necessary to protect the security or integrity of the Service.
46. Backups and Important Work
Second Pass should not be your only storage location for important creative work.
You are responsible for maintaining appropriate independent copies of:
- original project files;
- portfolio originals;
- source assets;
- videos;
- images;
- production files;
- code; and
- other important material.
Second Pass is a community and publishing service, not a guaranteed archival-storage service.
47. No Warranty Regarding Other Users
Second Pass does not guarantee that:
- another user is who they claim to be;
- a user is professionally competent;
- a user's Portfolio is complete;
- every project credit has been independently verified;
- every Contribution is correct;
- every Guide is error-free;
- users will behave professionally; or
- users will continue to participate in the Service.
Verification labels, if introduced, apply only to the specific matters Second Pass states were verified. They should not be interpreted more broadly.
48. Disclaimer of Warranties
To the extent permitted by applicable law, the Service is provided on an “as available” basis.
We do not promise that:
- the Service will always be uninterrupted;
- all Content will always remain available;
- every error will be corrected immediately;
- recommendations will always be relevant;
- search results will always be complete;
- Recognition systems will perfectly measure expertise;
- every Contribution will be accurate; or
- use of the Service will produce a particular educational, professional or commercial outcome.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
49. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
To the extent permitted by law, Second Pass is not responsible for indirect or consequential losses arising solely from:
- reliance on User Content;
- another user's conduct;
- off-platform transactions;
- third-party services;
- external websites;
- search-engine caching; or
- failure to maintain independent backups.
For users acting in a business or professional capacity, and to the extent permitted by law, Second Pass will not be liable for indirect, incidental, special or consequential commercial losses including loss of profits, contracts, goodwill, anticipated savings or business opportunities where such limitation is legally permitted.
Nothing in this section excludes liability for intentional misconduct, gross negligence or another category of liability that applicable law does not permit to be excluded.
50. Responsibility for Your Conduct
You are responsible for your own use of the Service and for Content you provide.
If you use Second Pass in a business or professional capacity and your unlawful Content or deliberate misuse causes the Service operator to face a third-party claim, you may be responsible for resulting losses to the extent permitted by applicable law.
Nothing in this section creates an unfair indemnification obligation for a consumer or removes rights that cannot legally be waived.
51. No Partnership or Employment Relationship
Using Second Pass does not create:
- employment;
- agency;
- partnership;
- joint venture;
- fiduciary relationship; or
- professional-client relationship
between you and Second Pass.
Receiving Recognition or becoming a prominent contributor does not make you an employee, representative or agent of Second Pass.
52. Transfer of the Service
Second Pass may in the future undergo:
- incorporation;
- business registration;
- restructuring;
- transfer;
- acquisition;
- merger; or
- another legitimate organisational change.
Contractual rights and obligations may be transferred where permitted by applicable law.
Any transfer involving personal data will remain subject to applicable data-protection law and the Privacy Policy.
Where users must be informed or consent is required, this will be handled in accordance with applicable law.
53. Governing Law
These Terms are governed by the laws of Finland, excluding conflict-of-law rules, except where mandatory law provides otherwise.
If you are a consumer residing elsewhere, this choice of law does not deprive you of mandatory consumer protections that apply to you.
54. Disputes
We encourage users to contact Second Pass first so that disputes can be resolved informally where possible.
Nothing in these Terms removes a consumer's right to bring a claim before a court having jurisdiction under applicable mandatory law.
Where Finnish consumer-dispute mechanisms become applicable to a particular service or transaction, information about the relevant available mechanisms will be provided as required.
For disputes involving users acting exclusively in a business or professional capacity, applicable jurisdiction will be determined in accordance with Finnish law unless another mandatory jurisdiction rule applies.
55. Regulatory and Legal Requests
Second Pass may comply with valid legal obligations, orders or requests issued by competent authorities. These may include:
- courts;
- regulators;
- law-enforcement authorities;
- Digital Services Coordinators;
- data-protection authorities; or
- other competent public authorities.
Requests will be assessed in accordance with applicable law. Where legally permitted and appropriate, affected users may be notified.
56. Severability
If a provision of these Terms is found invalid, unlawful or unenforceable, the remainder of the Terms remains in effect to the extent permitted by law.
The affected provision will be interpreted or adjusted as closely as reasonably possible to its intended lawful purpose.
57. No Waiver
If Second Pass does not immediately enforce a provision of these Terms, this does not mean the right to enforce it in the future has been permanently waived.
58. Entire Agreement
These Terms, together with policies and supplemental terms expressly incorporated into them, form the agreement governing your use of the Service. Depending on the features available, relevant documents may include:
- Privacy Policy;
- Community Guidelines;
- Cookie Policy;
- Copyright / Intellectual Property Policy;
- Moderation and Appeals information;
- Mentorship Terms;
- Payment Terms; and
- other feature-specific terms.
59. Order of Applicable Terms
If feature-specific supplemental terms expressly apply to a particular feature, those supplemental terms take precedence over these general Terms only to the extent of a direct conflict concerning that feature.
Mandatory applicable law always takes precedence where required.
60. Contact Information
Second Pass provides in-platform reporting and communication mechanisms for:
- general support: accessible to members through account management features and platform notices;
- legal enquiries: submitted via platform communication features; formal operator identity updates will be posted as operational status evolves;
- privacy matters: self-service data export and account erasure are provided via Account & Data Rights. Controller identification and detailed privacy practices are specified in the Privacy Policy;
- intellectual-property complaints: submitted directly on any affected Workbench, Pass, Contribution, Guide, or Portfolio Project via the built-in Report interface;
- security reports: submitted responsibly through platform report tools;
- illegal-Content reports: reported via the designated item-level reporting tool available throughout the Service;
- moderation appeals: tracked and reviewed through My Reports and associated enforcement notices.
SecondPass.net does not currently operate public email helpdesk mailboxes. Inquiries and notices should be submitted through the designated in-platform reporting and account mechanisms.
The identity and contact information of the person legally responsible for processing personal data will be provided in the Privacy Policy as required by applicable data-protection law. Inquiries and statutory data subject rights requests may be submitted directly using our public Privacy Request Form.
61. Plain-Language Summary
This section is provided for convenience. The numbered Terms above govern.
Your creative work remains yours.
Publishing artwork, renders, Portfolio Projects, Workbenches or Passes on Second Pass does not transfer ownership to Second Pass.
Public Content is public.
Public profiles, Workbenches, Passes, Portfolio Projects, Guides and Contributions may be visible on the internet and indexed by search engines.
Passes preserve iteration.
Publishing a new Pass does not automatically erase an earlier one.
Critique is allowed. Abuse is not.
Users can strongly disagree with creative or technical decisions, but harassment, threats and personal abuse are prohibited.
Only upload material you have the right to share.
You remain responsible for copyright, confidentiality and other rights relating to what you publish.
Recognition systems are community signals.
Helpful, Appreciation, Portfolio Recognition, levels, ranks and similar indicators do not represent money or professional certification.
Do not manipulate Recognition.
Fake Accounts, coordinated activity and artificial engagement may result in Recognition being reversed and Accounts being restricted.
Guides are curated but not guaranteed.
A Guide being accepted into the Library does not guarantee that it is perfect, universally applicable or permanently current.
User advice is not guaranteed.
Maintain backups and verify important technical changes.
Second Pass can moderate the platform.
Content and Accounts may be restricted where necessary to enforce rules, protect users or comply with law.
Moderation is subject to appropriate safeguards.
Where required by law, affected users will receive reasons and access to applicable forms of redress.
You can report illegal Content.
Second Pass provides or will provide an appropriate reporting mechanism.
Privacy is handled separately.
The Privacy Policy explains who controls personal data, what is collected and what rights users have.
Second Pass is currently independently operated.
It is not currently presented as a registered company. If a business entity is established later, the Terms and Privacy Policy can be updated accordingly.
Paid Mentorship is not currently covered by these general Terms.
If Second Pass later introduces Mentorship, payments or other commercial functionality, additional terms will apply.
Mandatory legal rights remain applicable.
Nothing in these Terms removes rights that cannot legally be waived.
